Contract Labor
Sorry about any confusion, but I have been advised to be careful in how I relate this situation but just wanted to pass this on. This is not only for electrical contractors.
At least in my part of the country ( SE Texas ), probably 99.9% of contractors end up hiring, at some point in time, day laborers / contract labor and / or being exposed to the general labor pool that is in a number of cities these days. They have access to enough info about us to build a pretty good case. From copies of payroll checks that they were paid with, verifying dates that they may have worked for us, your truck license number, your phone number. It doesn't take much. An ideal scenario for them would be as such...a couple of them go to work at a company for a couple of days, they have payroll checks, day, place, time...... and a witness.....his bud, to an "accident". I was shocked how easy this is.
I said all of that to say......
I don't know how they got the particulars on me but I received a certified letter today and it was from an attorney whose name I recognized as one that has nearly continuous advertising on most all of the tv channels here. He guarantees that he will get you money. There were plaintiffs listed in the letter and stated, very vaguely, that these plaintiffs had been involved in an accident with my truck on a particular date and that STATE LAW STATED THAT, IN ANY CLAIM LIKE THIS, THAT I HAD TO TURN ALL OF MY INSURANCE INFO OVER TO THEM so that the claim could be processed. I have been told....can't prove it....if there is enough evidence, it is cheaper for the insurance co. to pay the claim in most of these smaller claims.
Luckily, I called the attorney that sent the letter and told them that I work alone and don't know anything about any of these guys and they evidently have mistaken me for someone else. He began giving the description of the truck that they said that they were riding in and the truck they described was not mine. The thing that bothers me is we are out there trying to make a living and these scam artists are steadily trying to figure a way to beat us. Know who you hire.

Critique this situation, if you will, and tell me how I can avoid this?

1) That Pedro worked for you that day is (likely) immaterial. He copied down your license plate when you gave him a ride to the burrito stand as far as I'm concerned.
2) Yes, you need a lawyer (you should have one already).
3) The lawyer you really need (I hope) is working at your States Attorneys office in their Fraud unit.

Who worked for me when? I work alone.
How can the guy prove he worked for you?
If the lawyer told you he would sue to the point that they settle, I would call the state insurance commissioner and use the word "fraud" a lot.

My thoughts exactly. Must have been someone that looks like me.
