Default breaker as a switch?

is there any code violation when using breakers as a switch without installing a regular wall switch.this is for commercial job.

Actually it is pretty common.
For other than fluorescent or HID lighting any breaker is acceptable.
For switching fluorescent lighting the breaker must be listed and marked "SWD" or "HID".
For HID lighting the breaker must be listed and marked "HID".

See 404.11 and 240.83(D)

I am pretty sure they would need to be rated as a switch or SW.

Speedy's got you covered, but I just wanted to second the thought that this is a very normal thing to do for commercial lighting.

thanks guys,sorry i didnt tell you this .its for the bathroom lights in nite club,the owner doesnt want to install wall switch, instead of that he want to turn it off at panelboard circuit breaker.and bar lts and hall lts control at front counter using dimmer switch.
