Default Pigtails for Receptacles

I would like to know if a 20amp circuit is run for a living rm circuit and #12 wire is run can you tail to Receptacle with #14

no, how is that wire protected? 14awg is only good for 15A therefore it's not protected when on a 20A circuit

You can't. 310.15. It is not a tap, it is a branch circuit conductor, just like the rest of the circuit.
