Need an Inspector's clarification- Panel Change

I need clarification on an issue I saw at a friend's house who is currently getting a panel upgrade (to 200A) by a solar company.

The city he lives in currently recognizes the 2008 NEC.

In my knowledge the answer is yes, but I want to verify that.....

The old panel from when the house was built did not have ANY Arc-fault breakers, since a new panel is being installed I think that they now have to meet current code and MUST HAVE Arc-faults in the required areas... Isn't this true??

What are your guy's interpretations of new code requirements, with a panel upgrade versus old-work??

Like I said, I think that they DO HAVE TO put in AFCI's, but just to want verify.

This is most likely going to be a local issue. In MA the answer would be no, we wouldn't have to add afci's to existing circuits. Any new circuits or if we extend an existing circuit then we would have to afci protect it. But, in your example of just a panel upgrade, no.
