Need some advice.

Ok. So quick background on my situation. Back in July I get contacted by a builder doing a generator and wants an estimate for the electric. I give him an estimate and its approved, we sign a contract and get the paperwork in for the permits, and the homeowner orders the generator. I get a deposit and once the permit is back I start the work. Deposit was for roughly 40% of the job. This is where things go south. I've been 100% done with the project since July 31st, the builder failed his gas inspection and failed because the gen was too close to the house, this was on August 5th. On August 8th, I disconnect the electric to the gen so he can move the unit. At this point I tell the homeowner I will be back after everything is done and the plumbing is passed and hooked up, he said ok that's fine. So, up until 2 days ago I've been getting the run around from the builder. Turns out the homeowner sent him a letter on October 8th demanding his deposit back by 10/31 or he's gonna sue. He also hired new contractors to finish the job. I get a call today from the town telling me that the final inspection is tomorrow. WTF. They never did a contractor change. And finished the work under my name. How would u proceed

A mechanics lien is placed on the property where the work was performed. It is different than a lawsuit against the builder. Placing a lien on the property most times will encourage the property owner to contact the builder and recommend he get you paid to avoid further litigation.
Yea that doesn't work here.

You must have the lein in place prior to your invoice hitting the 90 day mark.

It takes about 70 days to get a lein.

So if someone doesn't pay you in 20 days and you haven't already filed to lien, you are too late.

That isn't going to help him.

The op needs to type up a letter on his letter head.

I joe blow electric and no longer responsible for inspections or permits at 123 deadbeat ave lot 1 block 69. Permit number 1234

The homeowner has hired someone else to complete my work. This person is now attempting to complete the work under my permit, a change of contractor has not be flied.

I job blow electric am requesting that a stop work order be issued for above addressed location until a permit can be re issued.

Don't sign it until you get to the construction office,it has to be notarized, any person in the construction office has to notarize it.

If they do not accept that and attempt to proceed with an inspection I would call the board of electrical contractors

FWIW rob Austin is a clueless tool! he is the one who was behind the infamous! the flooded wire can remain in place letter that he never signed

Contacted the DCA this morning and they said to write a letter as Rob mentioned. So I wrote a letter and will be dropping it off tomorrow.

Been there, done that.

I had a nut bag over the Sumer, sandy rewire. Guy took down all his Sheetrock on the first floor. We did a rewire and added recessed and ceiling fans.

Started the job in December. Calls me for a finish in febuary, we roll over there, there is no Sheetrock or insulation....wtf?

Plus there is all kinds of changes, they moved walls, moved plumbing fixtures, installed 2 zones of hvac

Call the guy,he gets nasty, does not understand why we can't just finish. I give him a price for the extra work, he goes for it, ask about permits for the other trades, he tells me that they don't need permits... Um ok pal but when I get this inspected your gonna to get caught... He replies I need this house for the summer

Now it's May, he emails me, I'm ready to finish, they are installing my kitchen appliances on Friday. Well listen I'm super busy now. I need three weeks before I can get there.

Out of curiosity I go over and look, still no Sheetrock and now an entire kitchen's worth of cabinets are stacked in the house.

Now he gets really pissed... At me. Listen I paid you to Install my breakers and devices go put them. Me... But it's not sheet rocked AND you paid me for the rough, you still owe me a trim deposit and a final payment... Him no I paid you to put them in.....me no you didn't, take a look at our contract..

Next day his lawyer calls me, if you don't go finish the job you were paid in full we will take legal action... I said " is this a f---ing joke? Am I being " punked" on MTV?

I explain my side to his lawyer and he says ummmm errr oh ahhhhhh well I think I have to call my client back and see about this.

Homeowner calls me, I am terminating your services and finding someone else.

Sounds good to me you lunatic, I went a wrote the letter like stated above, plus turned him in for the extra work. To this day there still is a big red stop work order on his front door, no work has been done since this went down in may.

The EI may have had that inspection already scheduled to be performed...it may have been his opportunity to "catch someone in the act".


Any idea if the job passed or not?
Go talk to the ****, tell them you wanted to talk before you filed charges for theft by deception.

Called the EI on Friday but had to leave a message. Hopefully will get a call back on Monday.

Some of them actually do call you back. He's one of them.

Rob, I see no problem with this juerk. I would have deviced it, put in four squares where necessary and received my final.

I have gotten a callback from every EI that I have left a message for....it's really not that unusual .

Yea I even have the four ones I mainly deal withs personal cell numbers.

One guy calls me on my cell when he gets to my jobs and has any questions or he just calls to let me know we passed.

If I was slow MAYBe but these days I have no time for that crap.

I got ten guys working six days a week, we aren't accepting any new customers, even when they beg.

It will be a good 2-3 years till I have to put up with crap like that again.

Hopefully another hurricane comes thru again soon, I know my house is good up to a cat 3..... :lol:

Unless the contract specifically states that only you or your company can do the work,I would send the contractor a bill once it is inspected and passed . Then the next day I would file a lien. I have seen stranger things work in a court of law. The homeowner will have to pay if the lien is validated even if he has already paid someone else.
